    Office of Labor Standards Announces First Settlement Under Seattle’s New App-Based Worker Paid Sick and Safe Time Ordinance

    $27,407.32 in Remedies Returned to 56 workers

    Seattle, WA (March 1, 2024) – The Seattle Office of Labor Standards (OLS) investigated Zinoff Enterprises, LLC dba DeliverThat and Zinoff & Company, LLC dba DeliverThat (DeliverThat) for alleged violations of the App-Based Worker Paid Sick and Safe Time (PSST) Ordinance. Additional violations were alleged under the Gig Worker Premium Pay and the Gig Worker PSST Ordinances. DeliverThat settled the allegations and agreed to pay a total of $27,407.32 to 56 workers.

    OLS alleged DeliverThat failed to:

    • Provide premium pay and a notice of rights to workers in violation of the Gig Worker Premium Pay Ordinance;
    • Establish an accessible PSST system for workers to request and use PSST under the Gig Worker PSST and the App-Based Worker PSST Ordinances; and
    • Provide workers with a monthly notice of PSST balance information, a notice of rights, and a written PSST policy under the Gig Worker PSST and the App-Based Worker PSST Ordinances.

    “On behalf of delivery drivers in Seattle I’d like to say thank you to Seattle OLS and DeliverThat for being able to reach a settlement. These ordinances are critical to maintain a quality and reliable driver base,” said Ryan Georgi, former DeliverThat driver.

    “A huge thank you to the Office of Labor Standards who helped with this settlement from DeliverThat and provided support to all drivers. You guys have been amazing since day one. I called the city and asked for help, and I was instantly taken care of, and within two months the investigation was ongoing. I am so grateful for your support. Thank you for the amazing job you’ve done and the resolutions we’ve achieved. It means the world to me,” said a DeliverThat driver.

    DeliverThat operates a catering delivery company and has approximately 17,000 drivers worldwide and dozens of drivers in Seattle.

    “The successful investigation and consequent settlement with DeliverThat serve as tangible evidence that Seattle’s app-based/gig worker protections are not just necessary, but effective in achieving their intended purposes,” said OLS Director, Steven Marchese. “We hope this settlement will inform other covered network companies as they navigate the new regulations and seek to comply with Seattle’s ordinances.”
