Seattle Office of Labor Standards Reaches Settlement with CVS Pharmacy for Second Violation of Secure Scheduling Ordinance

Seattle, WA (February 28, 2024) – The Office of Labor Standards (OLS) announces a settlement with CVS Pharmacy (CVS) for alleged violations of the Secure Scheduling Ordinance (SSO) at one of its Seattle locations.

OLS alleged that CVS failed to pay employees for employer-initiated schedule changes.

CVS settled the allegations and agreed to pay a total financial remedy of $88,260.85 to 38 employees and $6,695.64 to the City of Seattle for work performed during the period between May 2021 – March 2022.

This is the second violation of SSO premium pay for CVS. In the previous investigation, there were alleged violations of the Paid Sick and Safe Time (PSST) ordinance (accrual) and SSO (right to rest and premium pay) between 2014-2018 impacting 34 employees and spanning multiple CVS locations within the City of Seattle. In the first settlement, $14,150.19 in total financial remedies was returned to workers.

“Workers need reliable schedules for their well-being and productivity. Seattle’s Secure Scheduling Ordinance enables workers to plan their personal lives, manage child and elder care responsibilities, and maintain good health. Covered employers cannot unfairly deny workers these protections without serious consequences, especially when there have been repeated alleged violations. I am pleased OLS has been able to resolve this investigation by settlement with CVS, ensuring compensation goes directly to the employees involved,” said Steven Marchese, director, Office of Labor Standards.

CVS has more than 500 employees worldwide and operates in five Seattle locations.
