    Seattle Office of Labor Standards Invites Public Comment on Changes to Select Administrative Rules Proposed for Seattle’s TNC Driver Deactivation Rights Ordinance

    Public comments on proposed rule changes accepted until May 7, 2021

    Seattle, WA – (April 22, 2021) The Seattle Office of Labor Standards issues changes to select proposed rules that were announced on November 1, 2020 for administering the Transportation Network Company (TNC) Driver Deactivation Rights Ordinance (SMC 14.32). OLS invited public comment on those proposed rules until November 30, 2020. Upon consideration of public comment, OLS proposes changes to select proposed rules and invites the public to submit comments.

    Members of the public have 14 days – until May 7, 2021, at 5:00 pm PST – to comment on the changes to the proposed rules. The full text of proposed changes, as well as the original proposed Chapter, is available on the OLS website:

    This ordinance provides TNC drivers a right to be free from unwarranted deactivation and a right to challenge unwarranted deactivations before a neutral arbitrator. When final, the rules will be designated as Chapter 200 of the Seattle Human Rights Rules (SHRR).  

    The proposed changes provide additional clarity on topics like:

    • Consistency in the definition of temporary deactivation;
    • The timing of notice to a driver about their rights to challenge a deactivation; and
    • The definition and examples of egregious misconduct

    After the comment period ends, OLS will consider comments and issue final rules in before the ordinance becomes effective.
