For Immediate Release Contact Information Cynthia Santana/Communications Manager 206-256-5219 cynthia.santana@seattle.gov Seattle Office of Labor Standards Issues Proposed Administrative Rules for Seattle’s TNC Driver Deactivation Rights Ordinance Public comments on proposed rules accepted until November 30, 2020 Seattle, WA – (November 5, 2020) The Seattle Office of Labor Standards (OLS) has released proposed administrative rules for the Transportation Network Company (TNC) Driver Deactivation Rights Ordinance (SMC 14.32) for public comment. This ordinance provides TNC drivers a right to be free from unwarranted deactivation and a right to challenge unwarranted deactivations before a neutral arbitrator. When final, the rules will be designated as Chapter 200 of the Seattle Human Rights Rules (SHRR). Members of the public have 25 days – until November 30, 2020, at 5:00 pm PST – to comment on the proposed rules. The new rules clarify issues raised by the ordinance. For example, the rules define the terms “unwarranted deactivation” and “egregious misconduct,” and outline: Which drivers are eligible to challenge their deactivation from a TNC’s platform, The necessary contents of a notice of deactivation to a driver, and The arbitration procedures used by the Deactivation Appeals Panel, which is created by the ordinance. After the comment period ends, OLS will consider comments and issue final rules in 2021.
